Terms of Service

1. Acceptance of Terms

By accessing or using Nudgr at usenudgr.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms apply to all users of Nudgr, including free and paid accounts.

2. What Nudgr Does

Nudgr is an AI-powered sales follow-up assistant. It processes your sales call notes and generates personalised follow-up emails, then reminds you if your client has not replied after 48 hours. Nudgr is a tool to assist your sales process — it does not guarantee any business outcome, deal closure, or client response.

3. Free Tier and Paid Plans

Nudgr offers a free tier allowing up to 3 deal summaries. Beyond that, a paid Pro subscription is required. Pricing is displayed at usenudgr.com. We reserve the right to change pricing with 14 days notice. Paid subscriptions are billed monthly and can be cancelled at any time. No refunds are provided for partial months.

4. Acceptable Use

You agree not to use Nudgr to process data belonging to others without their consent, attempt to reverse engineer or scrape the service, use the service for illegal purposes, upload malicious content or attempt to compromise the service's security, or create multiple accounts to circumvent the free tier limit.

5. Your Data

You retain ownership of all data you input into Nudgr. By using the service, you grant Chest Card Inc a limited licence to process your data solely to provide the service. We do not sell your data. Your data is processed by Anthropic's Claude API to generate email content — see our Privacy Policy for full details.

6. AI-Generated Content

Nudgr uses AI to generate follow-up emails and deal insights. You are responsible for reviewing all AI-generated content before sending it to clients. Chest Card Inc is not responsible for the accuracy, appropriateness, or outcome of AI-generated emails. Always review generated content before use.

7. Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. Nudgr may be temporarily unavailable for maintenance or due to circumstances beyond our control. We are not liable for any loss resulting from service downtime.

8. Limitation of Liability

Nudgr is provided "as is" without warranty of any kind. Chest Card Inc is not liable for any indirect, incidental, or consequential damages arising from your use of the service, including lost deals, lost revenue, or data loss. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Account Termination

You may delete your account at any time from Settings → Account. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted within 30 days as per our Privacy Policy.

10. Governing Law

These terms are governed by the laws of the Province of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario, Canada. If you are a consumer in the EU or UK, you retain rights under applicable consumer protection laws in your jurisdiction.

11. Changes to Terms

We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of Nudgr after changes constitutes acceptance of the updated terms.
